GENERAL TERMS AND CONDITIONS OF BUSINESS
1. SCOPE
1.1 These general terms and conditions (hereinafter referred to as GTC) apply to concerts, theater and music events etc. organized by Porkcore – Events.
The following terms and conditions regulate the relationship between Porkcore - Events (hereinafter referred to as organizer) and the ticket buyers (hereinafter referred to as customer).
1.2 When purchasing the tickets, the terms and conditions of the sales partners apply in addition to these terms and conditions, as well as the terms and conditions including the house rules of the respective owner on the respective event site, insofar as these do not contradict the present terms and conditions.
1.3 Different general terms and conditions, in particular the customer's general terms and conditions, are not part of the contract, even if the organizer does not expressly object to their validity.
1.4 By purchasing an event ticket, the customer confirms that he has read the General Terms and Conditions and accepts them as binding.
2. CONCLUSION OF CONTRACT
2.1 Event tickets can only be purchased from the organizer or through their sales partners in advance booking offices.
2.2 Ordering tickets via sales partners
When purchasing event tickets via a sales partner of the organiser, reference is made to the general terms and conditions of the respective sales partner with regard to the modalities of concluding and processing the contract.
2.3 Ticket orders via the organizer
a) Ticket reservations can be made with the organizer by email.
Ticket reservations by the customer are considered provisional reservations and only become binding upon payment.
b) If the organizer confirms the provisional reservation, a deadline for payment will be given. If the customer fails to meet the payment deadline, the organizer's reservation commitment expires; in this case, the organizer reserves the right to otherwise dispose of the tickets after the deadline has expired.
3. PRICES, PAYMENT METHODS AND SHIPPING
3.1 Ticket prices may exceed the printed ticket prices.
The prices charged by the organizer are gross prices. The gross prices include the advance sales and distribution fees, the system fee including VAT, plus shipping costs.
Details of these charges will be given when the provisional reservation is confirmed; beyond this, there are no further, non-reported costs.
3.2 Discounts
a) Reductions for persons with a disability pass are only possible if they have a severely disabled pass and this shows the need for constant assistance (brand B) and corresponding proof is provided by sending a copy of the severely disabled pass in connection with the ticket order by email.
The accompanying person receives free entry to the event. Free tickets are only issued by the organizer.
3.3 The total price of the order including all fees is due for payment immediately after receipt of the confirmation of reservation by the organizer and must be paid in advance within the deadlines specified by the organizer.
When picking up the tickets from the organizer, cash payment is also possible if the pick-up takes place within the period specified by the organizer in the context of the reservation confirmation.
3.4 If the customer withdraws a transfer order without justification, he is obliged to reimburse the resulting costs, in particular the costs for returned direct debits, shipping and/or dunning costs.
3.5 The tickets are sent at no risk to the customer and are sent by registered mail. The dispatch takes place within 5 working days after receipt of payment.
If the money is received less than 10 days before the respective event, the tickets will no longer be sent to the customer.
You can purchase a Print at Home ticket via Eventim at any time up until the day of the event.
4. MISDELIVERY
Cards that have been sent and handed out must be checked immediately after receipt to ensure that they are correct in relation to the order; any complaints must be made in writing to the organizer immediately, no later than 8 days after receipt of the tickets by the customer.
Written form is sufficient if the customer sends the notification of the complaint to Porkcore - Events by e-mail.
5. RIGHT OF WITHDRAWAL AND RETURNS
Since Porkcore - Events offers services in the field of leisure events, in particular tickets for events, there is no distance contract, § 312b Para. 3 No. 6 BGB. A right of revocation and return is excluded for the order of such services. Each order of admission tickets is therefore binding immediately after confirmation by Porkcore - Events and obliges the customer to accept and pay for the ordered tickets.
6. RESELLING OF TICKET
6.1 For reasons of fairness and to avoid black market trading, the purchase of tickets per person is limited to a maximum of 10 event tickets and can be further limited for each individual event. The customer undertakes to purchase and use event tickets exclusively for private use, or only to pass them on to private customers and for private use.
6.2 Any professional or commercial further trading of the event tickets without the prior consent of the organizer is prohibited, in particular any resale by an unauthorized advance booking office. This also includes the sale of event tickets to third parties at inflated prices and an auction of the tickets via an internet auction with the intention of making a profit.
6.3 The sale of event tickets in front of the event location is prohibited without exception.
6.4 For each case of culpable infringement of the prohibitions mentioned in sections 6.1 to 6.3, the organizer can demand payment of a reasonable contractual penalty up to a maximum of € 1,000.00 from the customer.
6.5 Furthermore, the organizer reserves the right to prosecute persons who have reasonable grounds to suspect that they have violated paragraphs 6.1. to 6.3 to refuse or exclude access to the event and to refuse the sale of tickets in the future.
7. RETURNS OF TICKETS/REFUNDS
7.1 The return of sold tickets is generally excluded, no replacement will be granted for expired tickets.
7.2 The event can be canceled up to its start without giving reasons. In this case, there is only a right to a refund of the purchase price of the admission ticket. Any further (replacement) claim cannot be asserted.
7.3 The organizer also reserves the right to move events to other dates or locations for important reasons, in particular if artists are ill or similar.
If an event is moved to another event date or location, tickets already purchased remain valid.
7.4 If an event is canceled without replacement or is rescheduled to another date, the ticket price will be refunded. If the date is changed, reimbursement is limited to cases in which the customer is unable to attend the new event date.
The ticket price without fees will be refunded upon presentation of the original ticket at the place where the ticket was purchased.
The right to a refund expires if it is not asserted within two weeks of the performance date printed on the ticket at the place where the ticket was purchased.
7.5 Cancellation of a performance only entitles you to a refund of the ticket price if the cancellation occurs before the first break. In the case of a performance without a break, there is only a right to a refund of the ticket price if the cancellation occurs before the first third of the scheduled performance time.
The claim for reimbursement expires if it is not asserted against the organizer or the sales partner from whom the ticket was purchased within two weeks after the performance in question.
7.6 In addition to the claims for reimbursement of the admission price regulated in the preceding paragraphs, further expenses or damage incurred by the visitor will not be reimbursed.
7.7 The event takes place in all weather conditions as long as the organizer is responsible for the weather conditions. If the organizer sees a danger to the body and health of the visitors, the artists or the staff and/or material values due to the weather conditions, he is entitled to cancel the event.
The organizer is also entitled to delay the start of the event or to interrupt it due to weather conditions.
In this case, as well as if the event is canceled for other reasons of force majeure, due to an official order or a court decision, due to the endangerment of open-air or festival visitors due to the misconduct of others or due to other dangerous situations, there is no right to reimbursement or compensation, unless the organizer can be charged with intent or gross negligence.
8. ORGANIZER'S LIABILITY
The organizer is only liable in the event of intent and/or gross negligence.
The limitation of liability does not apply in the event of a breach of essential contractual obligations; the limitation of liability also does not apply to claims by the customer due to injury to life, limb and/or health of the customer due to culpable behavior on the part of the organizer.
Damage under the Product Liability Act remains unaffected by the above regulations.
The organizer is only liable for damage of any kind suffered by a visitor at the event location in the event of intent or gross negligence; liability for injury to life, limb and/or health remains unaffected.
Insofar as the organizer's liability is excluded or limited, this also applies to the liability of the organizer's vicarious agents.
9. OTHER
9.1 The domiciliary rights are the responsibility of the organizer, the instructions of the staff of the event location must be followed.
9.2 Dangerous items such as gas containers, pyrotechnic items (flares, fireworks, sparklers, etc.), laser pointers, weapons of any kind and pointed objects and objects that are suitable as projectiles, in particular bottles and cans, and umbrellas may not be taken to any event.
9.3 Animals may not be brought to the events.
9.4 Visitors under the age of 18 are subject to the provisions of the Youth Protection Act. Children and young people between the ages of 8 and 16 only have access when accompanied by a person who has custody or a person responsible for education.
9.5 Professional tape recorders, film, photo and video cameras may not be carried or operated at the event. This refers to photo or video functions. Recordings in any form are prohibited - any misuse will be legally prosecuted.
9.6 In the event of a breach of Section 9.3, the organizer and his employees are entitled to confiscate recording devices and cameras and keep them safe until the end of the event.
Recording materials of any kind on which parts of the event are recorded can be confiscated and kept by the organizer. They will be handed back to the owner if he has agreed to the prior deletion of the recording and has also signed a declaration of commitment not to use the audio and visual material for commercial purposes.
9.7 In the event of a breach of the above paragraphs, the organizer reserves the right to deny the persons concerned access to the event or to exclude them from the event. People who obstruct or harass ticket sales can also be expelled from the venue.
10. PROMOTER'S AUDIO AND/OR VIDEO RECORDINGS
In the event that image and/or sound recordings such as radio or television recordings are made during the event by authorized persons, the customer irrevocably agrees that words and images may be recorded and the recording without claim may be reproduced, distributed and publicly reproduced for a fee.
11. DATA PROTECTION AND DATA PROCESSING
The personal order data is collected, processed, stored and used in compliance with data protection law to the extent necessary for the initiation and execution of the contract.
If the customer has given his consent when making the reservation, personal data will be used not only to process the order but also for customer service purposes and the customer will be informed about other offers from the organizer.
12. GOVERNING LAW AND JURISDICTION
12.1 German law applies to the exclusion of the UN Sales Convention, to the extent permitted by law.
12.2 The place of performance and place of jurisdiction is Pegnitz if the customer is a merchant, a legal entity under public law or a special fund under public law.
12.3 These T&Cs exhaustively reflect what has been agreed. There are no further individual agreements, verbal or other ancillary agreements. Should individual clauses of these General Terms and Conditions be or become invalid, this does not affect the effectiveness of the other clauses. The ineffective clause is to be replaced by an effective clause that comes as close as possible to fulfilling the purpose of the contract based on the economic intention of the parties. The same applies in the event of a possible regulatory gap.
